Disaster law is today the most needed area of practice in Hatay, a province profoundly affected by the 2023 earthquakes. Damage assessment reports, entitlement applications, urban transformation decisions and insurance payments are governed by extremely short deadlines and combine technical and legal questions. How do I object to a damage assessment report?

Damage assessment results are published by public announcement, and an objection must be filed within the period stated in that announcement — in practice usually 30 days. If the objection is rejected, an annulment action may be brought before the administrative court. Because the deadlines are short, tracking the announcement date is critical.

What can I do if my entitlement application is rejected?

You may first appeal to the relevant commission; if that fails, an annulment action may be brought before the administrative court. Title deeds, building registration certificates, utility subscriptions and invoices are decisive in proving entitlement.

My DASK payment does not cover my actual loss. What are my options?

You may object to the loss adjuster's report, apply to the Insurance Arbitration Commission, or bring court proceedings. Losses exceeding the DASK coverage limit should be assessed separately under home insurance policies and through claims against those responsible for the damage.
